Terms of Service

1. Scope

These Terms of Service apply to the use of the service “Immo-KI”, provided by [Full name of the operator], [Address] (“Provider”).

2. Service Description

Immo-KI provides real estate agents with a digital assistant that can be integrated into the agent's website. The assistant answers inquiries from property seekers, recommends matching properties from the agent's portfolio, and captures contact details (leads).

3. Contract Formation and Registration

A contract is formed by registering on the platform and confirming the email address. The Free plan is free of charge and unlimited in time. Paid plans (Pro, Enterprise) are activated by completing a payment process via Stripe.

4. Prices and Payment

Current prices are available on the website under “Pricing”. All prices are exclusive of statutory VAT. Billing is monthly via Stripe. Supported payment methods: credit card and SEPA direct debit.

5. Cancellation

Paid plans can be cancelled at any time effective at the end of the current billing period. Cancellation is done via the dashboard under “Settings > Billing”. After cancellation, the account is downgraded to the Free plan. Data is not deleted.

6. Data Ownership

All property data uploaded by the agent (listings, images, property data) remains the exclusive property of the agent. The provider uses this data solely for the purpose of delivering the contractually agreed service and does not share it with third parties.

7. Availability

The provider strives for high availability of the service but cannot guarantee uninterrupted accessibility. Maintenance work will be announced in advance whenever possible.

8. Liability

The provider is fully liable for intent and gross negligence. For slight negligence, the provider is only liable in the event of a breach of material contractual obligations, limited to the foreseeable, typically occurring damage.

9. Final Provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction, insofar as legally permissible, is the provider's registered office. Should individual provisions be invalid, the remaining contract shall remain effective.
